About these terms

These Terms and Conditions ("Terms") are a legal agreement between you and Tickbig Networking Media Private Limited, No 3/5, Alonkar Aadharsh building, Ground Floor G1, 7th Avenue, Ashok Nagar, Chennai - 600083, India ("TickBig", "we", "us", "our").

They govern your use of the TickBig website at www.tickbig.com, the TickBig apps, Agent Ambo and all related services, including the Agent Ambo Smart Apply Chrome extension (together, the "Service").

By creating an account, clicking "accept", or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of a company or other organisation, you confirm that you have the authority to bind it to these Terms. If you do not agree, please do not use the Service.

Some features show additional terms when you start using them. Those terms form part of these Terms. If they conflict with these Terms, the feature's terms apply to that feature.

1. Definitions

• "Account" means the account you create to use the Service.
• "Agent Ambo" or "Ambo" means TickBig's AI agent and the features it powers, as described in section 7.
• "Applicable Laws" means all laws, rules, regulations, notifications, guidelines and orders of any government authority, tribunal or court in India.
• "Content" means any information or material on or through the Service, including profiles, resumes, portfolios, job and service requests, bids, messages, reviews, images, videos, prompts and campaign material.
• "Your Content" means Content that you upload, submit, create with Ambo or share through the Service.
• "TickBig's Content" means everything we create and provide in the Service, including its design, software, features, graphics, compilations, aggregate ratings and reports, but not Your Content.
• "Force Majeure Event" means any event beyond our reasonable control, such as natural disasters, epidemics, war, government action, internet or power failures, or changes made by third-party platforms.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract under Indian law to use the Service. You are responsible for complying with all laws that apply to you where you use the Service.

3. Your account

• Give us accurate, current and complete information and keep it up to date. TickBig is not responsible for problems caused by false, incomplete or outdated information.
• Keep your password secure. You are responsible for everything that happens through your Account.
• Your Account is personal. It cannot be transferred, assigned or sold.
• Do not impersonate anyone or misrepresent your identity, qualifications or affiliation with anyone.
• We may suspend or close your Account without notice if we reasonably believe your information is false, your Account is compromised, or you have broken these Terms.

4. Licence to use the Service

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for its intended purpose, in line with these Terms.

You must not:

• copy, modify, translate, decompile, disassemble or reverse engineer the Service, or try to do so;
• resell, rent or commercially exploit the Service, except as the Service intends (for example running your business through Find Clients);
• scrape, crawl or collect data from the Service using automated means, or access it except through the interfaces we provide;
• interfere with, overload or disrupt the Service or its security;
• use the Service in any way that breaks the law or these Terms.

5. Your Content

• You own Your Content. You give TickBig a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example format or translate), display and share Your Content, to the extent needed to run, improve and promote the Service and to perform the tasks you ask Ambo to do. For public Content, such as your profile or portfolio, this includes showing it to anyone.
• You are responsible for Your Content. You confirm you have all the rights and permissions it needs, including the consent of any person who appears in it, and that it is true and lawful.
• AI-generated output. Content Ambo creates for you, such as resumes, portfolios, scripts and videos, is yours to use, subject to these Terms and the rights of others. AI output may be inaccurate, incomplete or similar to output created for others. Review it before you use or publish it.
• Removal. We may remove or restrict any Content that we believe breaks these Terms or the law, or that is harmful, without notice.

6. Acceptable use

You must not use the Service to post, send or create Content that:

• is false, misleading or fraudulent, including fake jobs, fake candidates, fake reviews, fake bids or fake campaigns;
• harasses, threatens, defames or discriminates against anyone;
• is obscene, sexually explicit or harmful to children;
• infringes anyone's intellectual property, privacy or publicity rights;
• uses a real person's face, voice or likeness without their consent, or impersonates a public figure;
• spreads misinformation, or promotes violence, hatred, gambling or anything illegal;
• is spam, unsolicited advertising or a chain message, or contains malware.

You also must not use personal information you get through the Service, such as candidates', providers' or requesters' contact details, for any purpose other than the request or deal it was shared for.

7. Agent Ambo features

Agent Ambo acts for you inside and outside TickBig. When you use a feature, you authorise Ambo to take the actions that feature describes on your behalf.

7.1 Find a Job

• Ambo searches for and applies to jobs that match your preferences on supported platforms (such as LinkedIn, Naukri, Indeed, Hirist and Shine), sends applications by email to HRs, and fills in application forms on your behalf. Application volumes, platforms and the duration of your plan are as shown when you subscribe.
• By using Find a Job, you authorise us to share your resume, portfolio, profile and contact details with employers, recruiters, HRs and job platforms, inside and outside TickBig.
• Our methods for finding and applying to jobs are proprietary and confidential. We may not be able to tell you exactly where or to whom each application went, beyond the history shown in your account.
• You are responsible for the accuracy of your resume, preferences and answers.

7.2 Smart Apply Chrome extension

• To use Smart Apply, you must be a paid subscriber of the relevant Agent Ambo job seeker features, use Google Chrome on a computer, and stay logged in on supported platforms. Mobile is not supported.
• The extension may not work on some versions of Chrome or on some computers. Auto-filled details may not always be accurate.
• Job platforms set their own rules and may change their systems at any time. This can affect or stop Smart Apply. Platforms may restrict or suspend your account if they detect automated activity. You use Smart Apply at your own risk, and TickBig is not responsible for any action a platform takes on your account.
• We may add or remove supported platforms at any time, even during a paid plan.

7.3 AI Resume Builder

Resume scores and rewrites are suggestions generated by AI. You decide what goes on your resume, and you are responsible for keeping it truthful. Do not add qualifications, employers or results you don't have.

7.4 AI Portfolio and brand pages

Portfolios and brand pages are published on a public TickBig link and can be seen by anyone, including search engines. You are responsible for everything on your page, including any claims about your work, products or services. We may change link formats, or remove pages that break these Terms.

7.5 Hire Talent

• Post only genuine roles that you are authorised to hire for, with accurate details.
• Candidate details we share with you are confidential. Use them only to contact candidates about the role you shared. Do not pass them to anyone else.
• If a candidate says they're not interested, stop contacting them.
• Do not discriminate unlawfully, and never ask candidates for money.

7.6 Find Clients (service providers)

• You can register your services and get Client Alerts when someone requests a matching service in your area or category. You can bid and chat with them.
• Make sure your service details, credentials, prices, work samples and verified Instagram account are genuine and your own.
• TickBig introduces you to potential clients. It is not a party to your deal. Price, payment, delivery and any dispute are solely between you and the client. Do your own checks on every client.
• We do not guarantee any number of alerts, leads, clients or conversions. You may receive none during your subscription.

7.7 Find Vendors (service requests)

• When you post a request, your request and contact details are shared with matching service providers, who may bid, chat with you and contact you directly, including later.
• TickBig does not verify or guarantee the quality, safety, legality or professionalism of any provider or service, or that anyone will respond. Check providers yourself before you hire them.
• Any engagement, payment and dispute is between you and the provider. TickBig is not liable for any loss, fraud, spam or poor service by a provider.

7.8 Ambo Studio

• Ambo Studio creates videos from your prompts, scripts, photos and videos, including person swapping, restyling, remaking a format and voiceovers in different languages.
• Upload only material you have the right to use. Put a person's face into a video only with their consent. Never use Ambo Studio to create sexual content, to impersonate anyone, to show real people doing or saying things they didn't, or to mislead others.
• "Remake a viral video" uses the format and structure of a video you provide. Do not copy anyone's protected content, branding or creative work in a way that infringes their rights.
• Where the law or a platform requires it, label your content as AI-generated.
• Video length, languages, quality and the number of videos available depend on your plan. Generation can sometimes fail or produce unexpected results.

8. Fees, payments, cancellations and refunds

• Some features are paid. Prices, plan durations and what's included are shown before you pay. Prices exclude applicable taxes, such as GST, unless stated otherwise.

• You authorise us and our payment partners to charge your chosen payment method. For subscriptions, we may charge you again at each renewal until you cancel. We may change prices with advance notice. If you don't agree, stop using the paid feature before the change takes effect.

• Paying for a feature does not guarantee any outcome, such as interview calls, job offers, hires, leads, clients, sales, views or campaign results.

• Cancellation. Once a subscription fee is paid, it cannot be cancelled. No refund is given for cancelling a subscription or for unused parts of a plan.

• Refunds. There are no returns or exchanges for unused products in a subscription. If a payment fails but money is deducted from your account, we will investigate promptly. Once the failed transaction is verified, we will refund the deducted amount to your original payment method within 5 to 7 business days.

• We may suspend or cancel paid features if a payment fails or is reversed.

9. Third-party platforms and services

The Service works with third-party platforms and services, such as job portals, social networks, sign-in providers, payment partners and AI providers. We don't control them, and their terms and privacy policies apply to your use of them. TickBig is not responsible for their availability, changes or actions, or for any content on third-party sites linked from the Service.

10. Intellectual property

The Service and TickBig's Content, including the TickBig and Agent Ambo names, logos and mascot, are owned by TickBig or its licensors and protected by law. Nothing in these Terms transfers them to you. Do not use our trademarks without our written permission.

If you believe Content on the Service infringes your rights, email support@tickbig.com with the details and we will review it.

11. Disclaimers

The Service, Agent Ambo and all AI output are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and uninterrupted availability. You use the Service at your own risk.

We do not verify every user, job, candidate, provider or request, and we do not endorse them. Do your own checks before relying on anyone you meet through the Service.

12. Limitation of liability

To the maximum extent permitted by law:

• TickBig, its affiliates, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, opportunities, jobs, clients or reputation, arising from your use of the Service.
• TickBig is not liable for the acts or omissions of other users or third parties, including employers, candidates, service providers, requesters and job platforms.
• TickBig's total liability to you for any claim related to the Service will not exceed the fees you paid to TickBig for the relevant feature in the 12 months before the claim.

13. Indemnity

You agree to compensate and hold harmless TickBig and its affiliates, directors and employees against any claims, losses, liabilities and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your dealings with other users, or your breach of these Terms or the law.

14. Suspension and termination

You may stop using the Service and close your Account at any time. We may suspend or end your access, or remove Content, without notice if you break these Terms, if we're required to by law, or if your use creates risk for TickBig or others. Termination does not entitle you to a refund of fees already paid. Sections that by their nature should survive termination will do so.

15. Force majeure

We are not responsible for any delay or failure caused by a Force Majeure Event.

16. Changes to these Terms

We may update these Terms from time to time, for example when we add features. When we make material changes, we will tell you through the Service or by email before they take effect. The "Last updated" date at the top shows the latest version. If you keep using the Service after the changes take effect, you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Service will first be attempted to be resolved through good-faith discussion. If it cannot be resolved, it will be settled by arbitration in Chennai, India, under the Arbitration and Conciliation Act, 1996. Subject to that, the courts at Chennai, Tamil Nadu will have exclusive jurisdiction.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of assets. These Terms, with the Privacy Policy and any feature terms, are the entire agreement between you and TickBig about the Service.
